Now Accepting New DACA Applications

On Friday, December 4, 2020, Judge Garaufis of the U.S. District Court for the Eastern District of New York issued an order vacating the July 2020 Wolf memorandum and restoring DACA to the terms that were in place in 2012 when the program was first created.

As a result of the court’s order, on December 7, 2020, the government published a notice with the following:

  1. The government is now accepting first-time requests for DACA, renewal requests regardless of expiration date.
  2. Advance parole requests, based on the terms of the DACA program prior to September 5, 2017, and in accordance with the court’s November 14, 2020, decision
  3. The government is extending to two years any DACA and employment authorization documents (EADs) issued for one year instead of two years because of the Wolf memorandum and will provide evidence of this extension.

Our process for
NEW DACA applicants

The Latin American Coalition can help you submit your new DACA application. Please follow these steps:

  1. Complete the screening form found in this link to know your eligibility.
  2. A member of our legal clinic will call you to set up an appointment and complete the process.
  3. Please prepare and bring the following documents to your appointment:
  • Passport 
  • Birth Certificate with translation in English 
  • Non-immigrant visa (if available)  
  • School records since entered the US, showing physical presence in the US on June 15, 2007, June 15, 2012 and up to the present time) 
  • Medical, dentist or any other type of health record. 
  • School ID’s 
  • Vaccination record (issued in the US) 
  • High School Diploma 
  • Certificates, awards, recognitions received during school years 
  • Documents to show participation in sports or any extracurricular activities
  • Associates Degree  
  • Proof of GED completion or registration and attendance  
  • Proof of enrollment in a ESL program that is certified by the Department of Education 
  • Proof of College registration, attendance or completion 
  • Gym membership 
  • Cell phone bills or any other bill showing the applicant’s name, date and address in the US 
  • Taxes 
  • ITIN approval letter 
  • Marriage Certificate 
  • Children Birth Certificates (born in the US) 
  • Two passport style photos  

NOTE: THIS IS ONLY A GUIDE. ANY OTHER DOCUMENT CONTAINING THE APPLICANT’S NAME, DATE AND AN ADDRESS IN THE US WILL BE REVIEWED AND CONSIDERED BY OUR STAFF MEMBERS, TO SHOW THE PHYSICAL PRESENCE REQUIRED FOR THIS APPLICATION.
